1. SCOPE OF APPLICATION

A-Brands AG, headquartered in Herrliberg/Zurich (hereinafter A-Brands), is a Swiss exclusive distributor for baby, organic food & beauty products and offers online trading for the Aniball product through this website. These general terms and conditions apply to all orders placed on the website www.aniball-swiss.ch in the version current at the time of ordering.

2. ORDER AND CONTRACT CONCLUSION

You place an online order in the shop. The order becomes binding when you have agreed to the terms and conditions and pressed the "buy" button. This creates a legally valid purchase contract. After receiving your order, you will receive an order confirmation from us by email.

3. OUR DELIVERY AND SALES CONDITIONS

After order confirmation, we will send the ordered items to the delivery address you provided. The usual delivery time is 2-4 business days. Should delivery of the goods fail despite multiple delivery attempts, A-Brands may withdraw from the contract.

4. OFFER

Our online offer is subject to change and non-binding. Generally, the items offered in the online shop are available. Should it not be possible to deliver one or more items due to inventory discrepancies, A-Brands will inform you of this circumstance as soon as possible.

5. PRICES

Our sales prices are stated in Swiss Francs including statutory VAT and excluding shipping costs.

7. DELIVERY AND SHIPPING

7.1 SCOPE OF APPLICATION We ship exclusively within Switzerland and the Principality of Liechtenstein.

7.2 SHIPPING COSTS For our delivery within Switzerland and the Principality of Liechtenstein, you pay a shipping cost contribution of CHF 7.90.

8. PAYMENT OPTIONS

For orders within Switzerland and the Principality of Liechtenstein, the payment methods listed on the website are available to you. Orders from abroad can only be sent to a Swiss delivery address (please specify accordingly).

8.1 INVOICE When ordering by invoice (if provided and selectable), the invoice will be sent to you by email. The invoice is due within 30 days of the invoice date. You can conveniently pay the invoice cashlessly by post or bank transfer within this period.

8.3 PAYMENT DEFAULT In case of payment default, we charge a fee of CHF 15.00 from the 2nd reminder level onwards. The 2nd reminder is sent by post. In case of payment default, A-Brands is also entitled to assign the claim and cost consequences for the debtor to third parties. The assertion of further damages remains reserved.

9. RETENTION OF TITLE

The ordered goods remain the property of A-Brands until full payment.

10. RIGHT OF WITHDRAWAL/RIGHT OF RETURN

As these are hygiene products, the ordered items can only be returned due to a defect within 14 days of receiving the goods. The return is at your responsibility and expense. In case of legitimate defects, a replacement product will be sent and documented shipping costs up to a maximum of CHF 7.90 will be refunded. Only defective items will be accepted as returns. The items must be sent in the undamaged original packaging and will be inspected by quality management.

11. DELIVERY DEFECTS

We ask you to immediately check the delivered items for correctness, completeness, and integrity. Complaints regarding delivery scope, material defects, incorrect deliveries, and quantity discrepancies must be communicated in writing by email with photo within 5 business days of receiving the goods. The defect will be promptly reviewed by A-Brands. If the defect is accepted by A-Brands, you will receive an identical replacement item, if available. In this case, A-Brands will cover the costs of the return.

12. WARRANTIES

The warranties for items purchased from A-Brands are limited to the assurances of the respective manufacturer. Any claim expires in case of improper handling or personal intervention.

13. DATA PROTECTION

The protection of your personal data is important to us. We comply with applicable data protection regulations. We secure our website and other systems through technical and organizational measures against loss, destruction, access, alteration, or distribution of your data.

A-Brands is entitled to use your personal data to send you special offers or product information. You can revoke your consent to the use of your personal data for advertising purposes at any time by email to info@abrands.ch.

14. APPLICABLE LAW AND JURISDICTION

The contractual relationships between you and A-Brands are subject to substantive Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (UN Sales Law). The place of jurisdiction for all disputes is Herrliberg/Zurich. A-Brands is also entitled to optionally invoke the court at the customer's registered office/domicile.
